VEHICLE SALES TERMS

1. ABOUT THESE TERMS
These Vehicle Sales Terms apply when a vehicle is purchased from Silesia Automotive / Car Garage Crewe.
They should be read together with any vehicle order form, invoice, reservation confirmation, finance documentation and other information provided to you before the sale.
Where you are purchasing as a consumer, nothing in these terms is intended to remove or restrict rights given to you by law.
A vehicle sold to a consumer must meet the legal requirements relating to satisfactory quality, fitness for purpose and conformity with its description. These rights cannot be excluded by these terms.
2. OUR BUSINESS
Vehicles are offered for sale through Silesia Automotive from our premises in Crewe.
3. VEHICLE AVAILABILITY
All vehicles are offered subject to availability.
A vehicle displayed on our website does not automatically become reserved or sold merely because an enquiry has been submitted.
We recommend confirming availability with us before travelling to view a vehicle.
4. STOCK STATUS
Vehicles displayed on our website may be assigned a status to help customers understand their current availability.
The vehicle is currently being offered for sale, subject to confirmation.
The vehicle is expected to become available but may still be undergoing preparation, inspection or final processing.
A customer has entered into a reservation arrangement for the vehicle, subject to the applicable reservation terms.
The vehicle is no longer available for purchase, although its listing may remain temporarily visible.
5. VEHICLE DESCRIPTIONS
We take reasonable care when preparing vehicle descriptions, advertisements and listings.
Information may include:
- Make and model
- Derivative or trim level
- Registration year
- Mileage
- Fuel type
- Transmission
- Engine information
- Colour
- Equipment and features
- Service or maintenance information where available
If an error is identified in an advertisement, we will aim to correct it and notify a prospective buyer where the information is material to the proposed purchase.
Any correction to material vehicle information should be communicated before the sale is completed.
6. PHOTOGRAPHS & VIDEO
Vehicle photographs and videos are intended to represent the vehicle offered for sale unless clearly stated otherwise.
Lighting, reflections, display settings and camera equipment can affect the appearance of colours and finishes.
Images and video should therefore be considered alongside the written vehicle description and any inspection or viewing carried out before purchase.
7. LIVE VIDEO VIEWINGS
Customers may request a live video viewing of a vehicle.
During the viewing we can walk around the vehicle, show the interior and exterior and focus on specific areas requested by the customer.
Customers are encouraged to ask questions and request close-up views of anything that is particularly important to their purchasing decision.
A live video viewing does not remove any statutory rights that may apply to the subsequent sale.
8. USED VEHICLES
Vehicles offered for sale by us may be used vehicles and will therefore normally show some evidence of previous use.
The reasonable standard expected of a used vehicle will depend on relevant circumstances such as:
- Age
- Mileage
- Price
- Description
- Vehicle type
- Previous use
- Information disclosed before purchase
Normal age-related wear does not automatically mean a vehicle is defective, but this does not affect your statutory rights if the vehicle fails to meet the standard required by law.
9. MILEAGE
We take reasonable steps to record and present vehicle mileage accurately.
Where we become aware of a mileage discrepancy or are unable to reasonably verify a mileage history, this should be disclosed before a sale is completed.
The mileage shown on the vehicle at handover may vary slightly from the mileage stated in an advertisement because vehicles may be moved, inspected, demonstrated or test driven while offered for sale.
10. VEHICLE HISTORY
We may use available vehicle records and third-party information when preparing a vehicle for sale.
Any material vehicle history known to us that must legally be disclosed will not be deliberately withheld from the buyer.
Customers may also choose to obtain their own independent vehicle history report before purchasing.
11. WORKSHOP PREPARATION
Our sales vehicles may be inspected and prepared through our own workshop before being offered for sale.
Preparation may include inspections, servicing, repairs or maintenance considered appropriate for the particular vehicle.
The scope of preparation may vary according to the vehicle's age, mileage, condition and maintenance requirements.
12. INDEPENDENT INSPECTIONS
Customers may request permission to arrange an independent vehicle inspection before purchase.
Such inspections must be arranged in advance and carried out in a reasonable manner that does not damage or interfere with the vehicle.
13. TEST DRIVES
Test drives may be available by prior arrangement.
We may require a prospective driver to provide a valid driving licence and any other information reasonably required for insurance or security purposes.
Test drives may be refused where we reasonably believe that insurance, licensing, safety or security requirements are not satisfied.
14. VEHICLE RESERVATIONS
We may offer customers the ability to reserve a vehicle.
Where a reservation payment is required, the amount, duration of the reservation and any applicable refund or cancellation conditions should be explained before payment is made.
A reservation does not necessarily amount to completion of the vehicle purchase unless this has expressly been agreed.
We will not rely on terms that unfairly require a consumer to lose an excessive payment where this would be prohibited by law.
15. REGISTERING INTEREST
Customers may register their interest in vehicles marked Coming Soon.
Registering interest does not guarantee that the vehicle will become available, does not reserve the vehicle and does not create an obligation to purchase unless separately agreed.
16. VEHICLE PRICE
The agreed vehicle price will be confirmed before the sale is completed.
Any additional charges relating to optional services, delivery or other agreed items should be clearly identified before the customer becomes bound by the transaction.
If an obvious pricing error is discovered before a contract has been concluded, we will notify the customer as soon as reasonably possible.
17. PAYMENT
Payment must be made using a method accepted by us.
Unless otherwise agreed, the full amount due must be received and cleared before the vehicle is released to the buyer.
We may carry out appropriate verification or security checks before accepting certain payments or releasing a vehicle.
18. FINANCE
Where finance is available, it will be subject to separate eligibility requirements, lender terms, regulatory requirements and documentation.
References to finance on our website do not by themselves constitute an offer or guarantee of credit.
Any required information about the relevant lender, broker or finance intermediary will be provided separately where applicable.
19. PART EXCHANGE
We may accept another vehicle as part exchange.
Any initial valuation provided without physical inspection is provisional.
The final valuation may take into account:
- Vehicle condition
- Mileage
- Specification
- Service history
- Mechanical condition
- Bodywork and interior condition
- Tyres
- Warning lights or faults
- Previous damage or insurance history
- Outstanding finance
- Market conditions
20. INFORMATION ABOUT A PART-EXCHANGE VEHICLE
A customer offering a vehicle in part exchange should provide accurate information about the vehicle and disclose relevant matters that could materially affect its value or our decision to accept it.
The customer must have the legal right to dispose of the vehicle or authority from the legal owner to do so.
21. OUTSTANDING FINANCE ON PART EXCHANGE
If a part-exchange vehicle is subject to outstanding finance, this must be disclosed to us.
Any settlement arrangement must be agreed before ownership of the part-exchange vehicle is transferred.
22. COLLECTION
A collection date should be agreed once the sale is ready for completion.
Before the vehicle is released, we may require:
- Cleared payment
- Completion of required documentation
- Identity verification where appropriate
- Confirmation of any finance arrangements
- Completion of any agreed part-exchange arrangements
23. HOME DELIVERY
Home delivery may be available by agreement.
Any delivery cost, estimated delivery time and relevant arrangements will be confirmed before delivery is booked.
Unless the law provides otherwise, responsibility for the vehicle will remain with us until the vehicle is delivered into the physical possession of you or a person you have nominated to receive it.
24. INSURANCE & ROAD USE
The buyer is responsible for ensuring that appropriate insurance and any other legal requirements for use of the vehicle on public roads are in place from the point at which they become responsible for using the vehicle.
Customers should not drive the vehicle away without appropriate insurance.
25. REGISTRATION & DVLA
We will provide or complete applicable ownership and registration information as required for the sale.
The buyer is responsible for ensuring that any continuing obligations relating to insurance, vehicle tax and lawful road use are satisfied following handover.
26. WARRANTIES
A vehicle may be supplied with a warranty where this is expressly included in the sale.
Any warranty will be subject to its own terms, duration, exclusions and claims procedure.
A warranty is additional to your statutory consumer rights. It does not replace, reduce or remove those rights.
27. FAULTS AFTER PURCHASE
If you believe that a vehicle does not meet the standards required by law, please contact us as soon as possible and provide details of the issue.
We may ask to inspect the vehicle or obtain reasonable information necessary to investigate the fault.
Consumer remedies can include rejection, repair, replacement, price reduction or a refund in circumstances provided by law.
28. SHORT-TERM RIGHT TO REJECT
Consumer law may provide a short-term right to reject a vehicle during the first 30 days where the vehicle does not conform to the contract and the legal requirements for the sale.
Whether that right applies will depend on the facts and the relevant legal requirements.
Nothing in these terms is intended to interfere with that statutory right.
29. REPAIR OR OTHER REMEDIES
Where the statutory short-term right to reject does not apply or is not exercised, consumer law may provide rights to other remedies such as repair or replacement.
Further remedies may be available where a repair or replacement does not resolve the issue or cannot reasonably be provided.
30. CHANGE OF MIND
For a vehicle purchased in person at our premises, there is generally no automatic right to cancel solely because a customer has changed their mind, unless we have expressly agreed otherwise or the law provides a cancellation right.
Different rules may apply where the contract is concluded entirely at a distance.
31. DISTANCE SALES
Where a consumer vehicle purchase is concluded entirely by distance communication without the customer and dealer being physically present together, additional consumer cancellation and information requirements may apply.

32. BUSINESS PURCHASES
If a vehicle is purchased wholly or mainly for business, trade or professional purposes, the buyer may not be treated as a consumer for the purposes of consumer protection law.
Separate business-to-business terms may therefore apply.
33. VEHICLE OWNERSHIP
Ownership of the vehicle will transfer in accordance with the agreed sale arrangements and once applicable payment requirements have been satisfied.
We will not knowingly sell a vehicle where we do not have the legal right or authority to sell it.
34. CUSTOMER INFORMATION
Customers must provide accurate information where it is reasonably required to complete a transaction, registration, payment, part exchange, delivery or other element of the sale.
35. PERSONAL DATA
Personal information collected in connection with a vehicle enquiry or sale will be handled in accordance with our Privacy Policy .
36. COMPLAINTS
If you are unhappy with a vehicle or any part of the sales process, please contact us as soon as possible.
We will aim to investigate the issue fairly and respond with an appropriate proposed resolution.

37. LIABILITY
Nothing in these terms excludes or restricts liability where doing so would be unlawful.
In particular, nothing in these terms is intended to remove statutory rights relating to the quality, description or fitness for purpose of a vehicle sold to a consumer.
38. CHANGES TO THESE TERMS
We may update these Vehicle Sales Terms when our sales process, services or legal requirements change.
The terms applicable to an individual transaction will be the terms provided or made available in connection with that sale.
39. GOVERNING LAW
These terms are governed by the laws applicable in England and Wales.
Nothing in this provision removes any mandatory rights or protections available to a consumer.
